1. ACCEPTANCE OF TERMS
By downloading, installing, or using the 88888VPN application ("Service", "App", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease using the Service and uninstall the App.
AGE REQUIREMENT: You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years or older. We do not knowingly collect information from or direct any of our content specifically to children under 18.
2. SERVICE DESCRIPTION
88888VPN is a product of Fjolsky. The Service may include one or more of the following capabilities, depending on the specific application:
(a) Encrypted Relay Technology: End-to-end encrypted data relay connections designed to protect the confidentiality, integrity, and origin-anonymity of your interactions with AI platforms and academic resources in transit. Only designated platform traffic is relayed through our encrypted infrastructure; all other internet traffic remains on your direct local connection.
(b) AI-Generated Intelligence: AI and machine learning-powered analysis, reports, summaries, scores, and insights generated from publicly available data sources. All AI-generated content is provided strictly for informational and educational purposes only.
(c) Data Aggregation and Display: Real-time and historical data aggregation from third-party providers, presented through dashboards, charts, and structured views.
The specific features available to you depend on which Fjolsky application you are using. Available on iOS (Apple App Store), Android (Google Play Store), Windows (Microsoft Store), and macOS (Mac App Store). All user data is stored exclusively in Australia.
3. ACCOUNT REGISTRATION AND SECURITY
You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. Each account is limited to a specified number of concurrent device connections. You must notify us immediately of any unauthorized access or security breach.
4. PAYMENT AND ACCESS PERIODS
Payment Processing: All payments are processed through Stripe as single purchases. We do not process payments through app stores. Your payment card details are forwarded to Stripe at frontend for processing and are NEVER stored on our servers. We only retain transaction records (amount, date, status) for accounting purposes.
Access Period Packages: We offer various time-based access packages (e.g., 30 days, 90 days, etc.). Each purchase is a one-time payment for a specific access period. Prices displayed in Australian dollars (AUD). Access periods do NOT automatically renew — you must purchase a new access period before expiration to continue using the Service.
Account Access: You can access your account on any supported platform (iOS, Android, Windows, macOS) by logging in with your credentials.
5. REFUND POLICY
General Policy: Due to the nature of our Service, all sales are final. When you purchase an access period package, our infrastructure costs (server resources, bandwidth, processing capacity) are incurred immediately upon activation. These operational costs cannot be recovered once service access has been provided.
Important Notice: Refunds are generally not available for digital services after activation. This includes but is not limited to: change of mind, failure to use the Service, dissatisfaction with performance, account termination for policy violations, inability to access due to external factors (local network restrictions, platform policy changes, device compatibility), or user error.
Refund Requests: In exceptional circumstances and at our sole discretion, we may evaluate refund requests on a case-by-case basis. All refund decisions are final and non-appealable. To request consideration, contact support@customer.88888vpn.com within 7 days of purchase with your order details.
Approved Refunds: If approved, refunds are partial only (calculated based on infrastructure costs already incurred and service usage). Refunds are NOT processed through Stripe. You must provide valid government-issued identification (passport or driver's license) and corresponding bank account information for identity verification. Refunds are processed exclusively via Wise international bank transfer. Processing takes 5-10 business days after identity verification and bank details are confirmed. Original Stripe payment processing fees are non-refundable and will be deducted from any approved refund amount.
Legal Compliance: This policy does not affect your statutory rights under mandatory consumer protection laws where applicable.
6. ACCEPTABLE USE POLICY
You agree to use the Service only for its intended purposes as described in Section 2 and in accordance with all applicable laws and regulations.
You agree NOT to use the Service for: any illegal activities, distributing malware, unauthorized access to systems (hacking), harassment or threats, distributing child exploitation material, spamming or phishing, copyright infringement, DDoS attacks, circumventing access controls, or any activity that violates the rights of others. Accounts found violating this policy will be immediately terminated without refund.
7. SERVICE AVAILABILITY
We strive to maintain high uptime but do not guarantee uninterrupted service. Server availability may vary by location. Brief service interruptions for maintenance, updates, or technical issues may occur. We reserve the right to modify, suspend, or discontinue any aspect of the Service with notice when possible. Service interruptions do not entitle users to refunds except as outlined in Section 5.
8. INTELLECTUAL PROPERTY
All Service content, features, and functionality are owned by us and protected by copyright and trademark laws. You receive a limited, non-exclusive, non-transferable license to use the Service. You may not copy, modify, distribute, or reverse engineer any part of the Service.
9. PRIVACY AND DATA PROTECTION
Your privacy is important to us. Our Privacy Policy explains what data we collect, how we use it, and your rights. We only retain minimal data necessary for service operation.
10. LIMITATION OF LIABILITY
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
11. INDEMNIFICATION
You agree to indemnify and hold harmless 88888VPN from any claims, damages, losses, and expenses arising from your use or misuse of the Service, your violation of this Agreement, or your violation of any applicable laws.
12. TERMINATION
You may terminate your account at any time. Termination does not entitle you to any refund for unused access periods. We may suspend or terminate your account immediately, without notice or refund, for violation of this Agreement, fraudulent activity, abuse of resources, or legal requirements. All outstanding amounts remain due upon termination.
13. DISPUTE RESOLUTION
This Agreement is governed by applicable law. Disputes shall be resolved through binding arbitration on an individual basis. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS-ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.
14. AFFILIATE PROGRAM
We may offer an affiliate/referral program. Affiliates earn rewards on referred customer payments. Reward rates and terms are subject to change. We reserve the right to withhold rewards for fraudulent referrals.
Affiliate Rewards: Payouts are processed only via Wise. Minimum withdrawal thresholds apply.
Prohibited Activities: False advertising, trademark misuse, spam, cookie stuffing, and other fraudulent techniques.
15. ACCOUNT DELETION AND DATA RIGHTS
Account Deletion: You may request account deletion at any time by contacting support@customer.88888vpn.com. Upon deletion, your account data will be permanently removed within 30 days, except where retention is required by law.
Data Access: You have the right to request a copy of your personal data. Contact privacy@legal.88888vpn.com to exercise this right.
Data Portability: You can export your account data before deletion by requesting it through our support channels.
16. APP PERMISSIONS
App Permissions (iOS/Android/Windows/macOS): The app may request the following permissions depending on its functionality:
- Network Access: Required to connect to our servers and third-party data providers
- Network Configuration: Required if the Service includes encrypted relay functionality to selectively route designated traffic through our infrastructure
- Notifications: Optional, for service alerts and access period expiration reminders
- Storage: Minimal, for app preferences and configuration
All permissions are used solely for service functionality. We do not access personal files, contacts, camera, microphone, or other sensitive device data unless explicitly required and disclosed.
17. MODIFICATIONS
We reserve the right to modify these Terms at any time. Changes will be effective 30 days after notice for existing users (via email or in-app notification). Continued use after changes constitutes acceptance. Major changes will require re-acceptance in the app.

20. GOVERNING LAW
Governing Law: This Agreement is governed by the laws of Queensland, Australia. Disputes shall be resolved in courts within that jurisdiction.
21. SEVERABILITY
Severability: If any provision is invalid, the remainder remains enforceable.
22. ENTIRE AGREEMENT
Entire Agreement: This document supersedes all prior agreements.
23. COOPERATION WITH AUTHORITIES
Cooperation with Authorities: We may disclose your information if legally compelled (e.g., court order under Australia's Telecommunications Act 1997 or Surveillance Legislation Amendment Act 2021).
24. USER RESPONSIBILITY
User Responsibility: You must comply with all applicable laws, including export controls and sanctions (e.g., Australian Autonomous Sanctions).
25. AI-GENERATED CONTENT DISCLAIMER
Where the Service includes AI-generated content (including but not limited to reports, analyses, summaries, scores, estimates, and recommendations), the following terms apply:
(a) Not Professional Advice: AI-generated content does not constitute financial, investment, legal, medical, or any other form of professional advice. You must conduct your own independent research and consult qualified professionals before making decisions based on AI-generated content.
(b) No Guarantee of Accuracy: AI-generated content may contain errors, inaccuracies, outdated information, or misinterpretations.
